Terms of Service
These Terms of Service ("Terms") govern your use of brood.gg, the Brood Discord application, and any related services (together, the "Services") provided by Brood ("Brood", "we", "us"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old, or the minimum age required by Discord or the laws of your country, to use the Services. If you use the Services on behalf of an organization or a Discord server, you confirm you have authority to accept these Terms for it.
Discord
Your use of the Brood Discord application is also subject to Discord's Terms of Service, Community Guidelines, and Privacy Policy. We are not affiliated with or endorsed by Discord, and we are not responsible for Discord's platform or its availability.
Acceptable use
You agree not to:
- Use the Services for anything unlawful, harmful, harassing, or abusive.
- Submit content that infringes anyone's rights or that you do not have the right to share.
- Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Services or related systems.
- Use automated means to access the Services in a way that exceeds normal use.
- Use the Services to spam, impersonate others, or distribute malware.
We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other users.
Your content
You keep ownership of content you submit to the Services. You grant Brood a worldwide, non-exclusive, royalty-free license to host, store, use, reproduce, modify, and display that content as needed to operate, provide, and improve the Services. You are responsible for your content and confirm that you have the rights needed to grant this license.
Generated content
The Services may produce content automatically, including with the help of artificial intelligence. Generated content may be inaccurate, incomplete, or unexpected, and may be similar to content produced for others. Use your own judgment before relying on it.
Our property
The Services, including their software, design, branding, and content we provide, are owned by Brood or its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.
Feedback
If you send us ideas or feedback, we may use them without restriction or obligation to you.
Changes to the Services
The Services are in development. We may add, change, suspend, or discontinue any part of them at any time without liability to you.
Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that data will not be lost.
Limitation of liability
To the fullest extent permitted by law, Brood and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Services in the 12 months before the claim or £50.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
Indemnity
To the extent permitted by law, you agree to indemnify and hold Brood harmless from any claims, losses, and expenses, including reasonable legal fees, arising from your use of the Services, your content, or your violation of these Terms.
Termination
You may stop using the Services at any time, including by removing the Brood application from Discord. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, and governing law.
Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that if you are a consumer you may also have the right to bring proceedings in your country of residence.
Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date above. Continuing to use the Services after an update means you accept the revised Terms.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Brood about the Services. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition, or sale of assets.
